A Superior Court justice in Hamilton has halted a murder trial and granted a judicial stay due to serious errors made by two Crown attorneys. The decision frees the accused, Salomon Bashir, from facing second-degree murder charges in the death of Everton Frost. Justice Giulia Gambacorta criticized assistant Crown attorneys Michael Dean and Steve Kim, along with Hamilton police, for their negligent handling of crucial DNA and cellphone tower evidence, which compromised Bashir’s right to a fair trial.
Gambacorta highlighted that the failure to disclose important evidence to the defense before the trial prevented Bashir’s legal team from adequately preparing. She described the Crown’s conduct as falling below the standards of fundamental fairness, leading to an abuse of the judicial process. The judicial stay, a rare remedy, was deemed necessary to address the clear misconduct in the case.
Lack of Disclosure on DNA Evidence
Bashir was arrested in connection with Frost’s shooting death in 2023. New DNA evidence linking Frost’s brother to a key piece of evidence was not disclosed promptly by the police or the Crown. The delay in sharing critical information with the defense raised concerns about the integrity of the legal proceedings.
Cellphone Tower Data Mishandling
Additionally, the Crown’s mishandling of cellphone tower data, crucial for linking Bashir to the crime scene, further exacerbated the situation. Failure to inform the defense about expert witnesses and the delayed acquisition of necessary evidence led to a breakdown in the trial process.
Despite the Crown’s request for a mistrial and a new trial, Gambacorta upheld the judicial stay, emphasizing the need to protect Bashir’s right to a fair and timely trial. Defense lawyers expressed dismay at the lackadaisical approach of the Crown’s office and emphasized the importance of upholding fair trial rights for all individuals.
