Alberta Government Sues Winnipeg Hospital for Negligence

The Alberta government, along with the father of a man who suffered severe brain damage following an alleged overdose of a potent sedative at a Winnipeg hospital, has filed a lawsuit against the facility, three medical providers, and two health authorities in Manitoba for negligence. Zachary Hoogerdyk’s father, Edward Hoogerdyk, and the Alberta government are taking legal action against the Winnipeg Regional Health Authority, Shared Health, Concordia Hospital, a doctor, and two other medical providers. The lawsuit states that Zachary Hoogerdyk, a 23-year-old from Calgary, visited Concordia’s urgent care center on March 25, 2024, during a trip to Winnipeg due to worsening cold symptoms. He was diagnosed with low oxygen levels and influenza B, leading to the administration of propofol, a sedative used for ventilator patients. However, the lawsuit alleges that he received a significantly excessive dose of propofol, resulting in cardiac arrest and severe brain damage.

The lawsuit further claims that Zachary Hoogerdyk now requires constant care and will never regain full cognitive abilities. The legal action also mentions that Hoogerdyk’s vital signs deteriorated rapidly after the overdose, leading to cardiac arrest and subsequent amputations due to medical complications. The lawsuit accuses medical staff and the involved health authorities of negligence and breaching the standard of care owed to Hoogerdyk. It seeks damages for emotional support, rehabilitation costs, and ongoing care needs. The Alberta government is also seeking compensation for the health services provided to Hoogerdyk post the incident. Both the Winnipeg Regional Health Authority and Shared Health have declined to comment on the ongoing lawsuit.
