Three individuals accused in the death of a well-liked restaurant owner in Owen Sound, Ontario, have agreed to be extradited from Scotland to face trial in Canada. Robert Evans, aged 25, is charged with manslaughter, while his father Robert Busby Evans, 47, and uncle Barry Evans, 54, are facing charges as accessories after the fact.
Legal expert Robert Currie from Dalhousie University mentioned that the trio could be transported to Canada soon pending the finalization of agreements between Canadian and UK authorities on the terms of extradition. The process is expected to be expedited as the extradition is uncontested.
The tragic incident occurred when Sharif Rahman, the owner of Curry House in Owen Sound, was fatally injured in August 2023 after confronting patrons who attempted to leave without paying their bill. The accused individuals appeared in Edinburgh Sheriff Court where they consented to be extradited to Canada for the legal proceedings.
The court confirmed that if found guilty, time spent in Scottish custody awaiting extradition may be considered for sentence reduction, as per a letter from Canadian authorities dated October 3, 2025. The extradition consent process was completed for each of the individuals, including Busby Evans, Robert Evans, and Barry Evans.
Upon arrival in Canada, the accused individuals will be treated like any other criminal defendant awaiting trial. Reasons behind their decision to consent to extradition remain undisclosed, and it is unclear if a report on Ontario jail conditions, requested by the court, was submitted. Currie emphasized that there is no special treatment for foreign nationals in the legal process.
Previously undisclosed details about the accused individuals were revealed through a CBC News investigation, which uncovered their social media profiles. The investigation unveiled images of the accused men and their connections through social media platforms.
Allegations suggest that Robert Evans Jr. was involved in the fatal altercation, while Barry Evans and Robert Evans Sr. face charges related to aiding Evans Jr. after the incident. The family members allegedly used fake identities to enter Canada as visitors and operated a cash-only business during their stay.
The court is yet to announce an official extradition date for the accused individuals.
