The Alberta Energy Regulator (AER) has instructed oil and gas company MAGA Energy Ltd. to halt its operations due to unresolved environmental issues and non-compliance problems, such as outstanding taxes and orphan well cleanup fees. The AER made the announcement on Thursday after issuing the order a day earlier. According to the directive provided by the agency, MAGA Energy must cease operations at its wells and facilities, as well as discontinue the use of active pipelines within two weeks.
MAGA Energy currently possesses 581 wells, 108 facilities, and 801 pipeline segments, as reported by the AER. The regulator stated in a press release that the action was taken to safeguard the public and the environment. Due to the company’s outstanding municipal taxes, debts to the AER and Orphan Well Association, and failure to meet obligations, the AER concluded that MAGA Energy lacks the capacity to fulfill its regulatory and liability duties.
Before resuming operations, MAGA Energy must fulfill several requirements outlined in the order, including addressing remediation issues at multiple sites, resolving pending field inspections, and allocating the minimum mandatory funds for the cleanup of inactive sites. Sturgeon County informed CBC News that MAGA Energy owes over $356,000 in property taxes and penalties, emphasizing the importance of companies meeting their tax obligations promptly.
Critics like Janetta McKenzie from the Pembina Institute have raised concerns about the regulatory process, suggesting that the AER may not be enforcing rules effectively and promptly. A recent report highlighted the challenge of recovering approximately $250 million in unpaid taxes from oil and gas companies in Alberta. McKenzie emphasized the need for increased accountability and stricter enforcement to prevent financial and environmental burdens from falling on Albertans.
Moreover, landowner Mark Dorin, affected by the situation, plans to seek compensation through the Land and Property Rights Tribunal under the Surface Rights Act. He expressed concerns about the growing financial liability resulting from MAGA Energy’s actions and the potential risks posed by improperly managed wells leaking pollutants into the environment.
