A homeowner in Kensington Market expressed frustration over the recurring rat infestation on Ellen Avenue behind her property and called for the city to address the cleanliness of the area. However, the city claims it does not own the property, and its ownership remains unidentified.
Cristina Enrietti, who owns three adjacent houses, described the area as dirty, with needles, litter, and a significant rat presence, especially at night. Ellen Avenue is categorized as an orphan property, an aged street or laneway with no current legal owner, dating back to 1898 when it last changed hands.
City Councillor Dianne Saxe is investigating the issue but stated that the city lacks the authority to intervene on private property. Local historian Adam Wynne highlighted the prevalence of orphaned properties in Kensington and suggested that the city conduct a comprehensive survey to assume responsibility for their maintenance and potential development.
Real estate lawyer Bob Aaron explained the historical origins of these properties from the 1800s, attributing their existence to poor planning practices. He emphasized the challenges associated with these properties, noting their minimal value and the reluctance of any party to assume ownership and maintenance responsibilities.
Enrietti, acknowledging the city’s non-ownership of Ellen Avenue, emphasized her expectation as a taxpayer for a clean neighborhood. City officials are exploring potential solutions for Ellen Avenue and the broader issue of orphaned laneways, with hopes that future property owners may voluntarily adopt and improve these neglected areas.
Despite the possibility of new owners taking over these laneways, Aaron expressed skepticism due to their perceived lack of value. He cautioned against the financial burden and practical challenges associated with maintaining these orphaned properties, suggesting that finding willing owners may prove challenging.
