Family of Tragic Highway 401 Collision Victims Seeks $25M in Lawsuit

A family bereaved by a tragic wrong-way collision on Highway 401 last year has initiated legal action against the involved officers, the police board, and the estate of the deceased suspect who caused the crash. Gokulnath Manivannan and Ashwitha Jawahar, the only survivors of the April 2024 incident, lost Manivannan’s parents and their three-month-old child in the tragic event. The lawsuit, brought forward by the couple and two other family members, seeks $25 million in compensation, alleging negligence on the part of the defendants, including two officers, Durham Regional Police, Ontario Provincial Police, and the estate of the pursued suspect.

The collision occurred on April 29, 2024, following a police pursuit stemming from an alleged liquor store robbery in Bowmanville, Ontario. The suspect drove the wrong way on Highway 401 in Whitby, resulting in the fatal crash involving at least six vehicles. The suspect and the pursuing officers faced tragic outcomes. Subsequent investigations led to criminal charges against two Durham police officers, Sgt. Richard Flynn and Const. Brandon Hamilton.

The family’s legal claim asserts that the suspect acted recklessly, while the officers’ decision to engage in the pursuit without considering alternatives was deemed reckless, leading to fatalities and injuries. Durham police are accused of inadequate training in apprehension pursuits and failing to intervene to halt the pursuit. The lawsuit, filed recently, awaits responses which have not been tested in court.

The family continues to endure significant physical, emotional, and financial burdens from the aftermath of the crash, including ongoing medical expenses, loss of income, and impaired daily activities. Their legal representatives, Brad Moscato and Adam Wagman from Howie, Sacks & Henry LLP, stress the importance of a comprehensive investigation to provide the family with the answers they seek regarding the tragic incident. The family’s hope is that this incident prompts a review of pursuit authorization procedures to prioritize public safety above all else.
