Canada, while not a traditional superpower, was described as a “democratic superpower” by Chief Justice Richard Wagner during the opening ceremony of the Supreme Court’s judicial year. Wagner emphasized the importance of the rule of law and judicial independence, stating that they serve as crucial defenses against tyranny and autocracy. He highlighted the necessity for accessible and fair justice delivered by well-trained judges to bring judicial independence to life for Canadians.
Celebrating the 150th anniversary of the Supreme Court, the ceremony marked a significant milestone, with Justice Minister Sean Fraser, legal professionals, academics, and former court members in attendance. Reflecting on the court’s history since 1875, Wagner called for a reaffirmation of principles such as the rule of law, an independent judiciary, and equal access to justice, which have been fundamental to Canadian jurisprudence and democracy.
In a symbolic gesture, Supreme Court justices unveiled new black robes with red accents, departing from the traditional scarlet robes with white fur trim. Wagner noted that the modern design of the new robes signifies the court’s commitment to openness and accessibility, reflecting a distinctly Canadian approach.
Additionally, Wagner announced the creation of a Supreme Court historical society to preserve and honor the court’s legacy through research, education, and public engagement. Minister Fraser underscored the importance of defending democracy and upholding the rule of law amid global uncertainties and challenges to established norms.
Fraser urged all Canadians, including elected officials and judges, to actively protect and nurture democracy by embracing the values that underpin a just society. Emphasizing the collective responsibility to safeguard rights and institutions, he stressed the need for proactive engagement to ensure the longevity of the Supreme Court and Canada’s democratic principles for generations to come.
