Quebec Introduces Bill for Mental Health Detention

The Quebec government has introduced a new bill aimed at facilitating the involuntary detention of individuals whose mental health poses a risk to themselves or others. This legislation, presented on Tuesday, seeks to modify the existing criteria for confining individuals experiencing mental health crises.

Under current Quebec law, individuals can be involuntarily confined if they present an immediate and serious danger to themselves or others. The proposed bill would expand this criteria to allow doctors and other healthcare professionals, including nurse practitioners, to detain individuals who are in situations deemed risky to themselves or others.

Previously, only physicians had the authority to confine individuals and request psychiatric evaluations. Quebec Health Minister Sonia Bélanger emphasized that the new law aims to strike a balance between protecting individuals and respecting fundamental rights.

The changes come in response to two notable incidents: the fatal stabbing of police officer Maureen Breau in 2023 and the death of dépanneur owner Chong Woo Kim. Concerns had been raised about the alleged perpetrators in both cases prior to the tragic events.

The union representing Quebec provincial police officers expressed support for the bill, likening it to Ontario’s Brian’s Law. Psychiatrist Amal Abdel-Baki highlighted the importance of timely access to treatment for individuals with mental health disorders to prevent harm to themselves or others.

However, some advocacy groups, like AGIDD-SMQ, view the bill as regressive, expressing concerns about potential distrust towards mental health providers and the impact on patients’ experiences with confinement. They fear that granting psychiatrists increased powers to hospitalize individuals may exacerbate social divides rather than address underlying issues.
